Spousal IRA

I have a client with an IRA already…she earns no money, retired collecting a pension age 61. Her husband has W2 earnings, and is not covered by a company Retirement plan or 401k. Can she contribute to her IRA as a spousal contribution?

She is not working and is not covered by an employer sponsored plan…she is collecting a NYS Retirement Pension.

Their total AGI is less than $90K.

I am looking to have them contribute a total of 12k. $6,000 each. They are both over age 50.

I believe the answer is yes. Juct double checking to see if I am missing anyting.

She can make a spousal contribution using husband’s earned income. If husband was not yet 70.5 in 2012, he can also make a TIRA contribution, max of 12k for both spouses. TIRA contributions would both be deductible.
