Capital Gain Distribution From Complex Trust To Beneficiary

Granted this question does not fall within the scope of an IRA so I apologize upfront. I know this forum has some very smart minds that be be able to answer my question.

If a complex irrevocable trust were to make a long term capital gain distribution to the beneficiary of the trust, how would the
distribution be taxed? Would the beneficiary's distribution be taxed as long term capital gains?

Thank All Who Contribute,

Keith James

  • Distributions generally carry out ordinary income but don't carry out capital gains.  However, there are some exceptions.  The trustee should consult with competent tax/estates counsel.
